The Hotel DA has been rejected and Mudgee's Regent Theatre!
At the site inspection and the hearing, Council’s barrister, Ms Hemmings, strongly argued and the Commissioner seemed to accept, that the application before the Court had serious shortcomings including in respect of the lack of an acoustic assessment and lack of detail of works required to the Theatre.
Yesterday, the Applicant agreed to discontinue the proceedings. This means that the appeal will not continue, and has the effect that the Council’s refusal of consent to the development application stands.
The Applicant cannot appeal against the refusal of this particular development application again. However, please note that this does not prevent the applicant from lodging a further development application for the Theatre in future.
